Introduction:
This Course aims to strengthen Brazilian legal professionals’ qualification in the field of Civil Law, a transforming field in which professional success requires constant renewal and enhancement of knowledge and abilities.
In Brazil, the Civil Code has been valid for about 15 years, always in connection to other regulations (that also are constantly revised) and at the same time as intense social and economic transformations and jurisprudential reinterpretations which largely impact social and legal life.
This professional field’s dynamism requires solid theoretical and practical formation and being updated and alert to current debates regarding doctrine and jurisprudence, which are necessary not only to those already working in this field but also to those preparing to enter a legal or academic career.
Both the mastery of traditional institutions and dogmatic fundamentals of legal practice and the development of an interpretative structure (for comprehending legal text in reference to the Constitution and to the demands of each case), of rhetoric (the power of persuasion) and of the philosophical basis (the ability to substantiate solutions with legal principles – especially the principle of human dignity) are addressed in this Course, contributing to the effective concretization of private rights, as well as to scientific research in this important field of Law.

He holds an Undergraduate Degree (USP, 1998), a Master’s Degree (UFMG, 2003), a Doctoral Degree (UFMG, 2006) and is an Associate Professor in Law (USP, 2009). He also has a Post-Doctorate Degree in Philosophy (UFMG, 2011) and in Law (University of Munich, 2013). Currently is a Professor at the Law School of Ribeirão Preto (USP), at the Ribeirão Preto University (UNAERP) and at Universidade Santa Úrsula (USU).

Iara Pereira Ribeiro
She holds a Doctoral Degree in Civil Law, granted by PUC/SP (2013) and a Master’s Degree in Law Philosophy through PUC/SP (2000). She obtained her Undergraduate Degree in Law at PUC/SP in 1992 and in Portuguese and Linguistics at USP in 1996. Today she is a professor at the Private Law and Civil Procedure Department at the Law School of Ribeirão Preto (University of São Paulo).

Modules, programs and objectives:
Module I – Private Law Fundamentals (116h)
The aim of this module is to offer theoretical and philosophical presuppositions that enable the student to take on the themes of this course. It aims specially to illustrate Law as a critical way of thinking.
Evaluation: This module’s evaluation will consist of technical and legal work, through analysis of appellate decisions, preparation of legal pieces, reports or other formats that may be suggested by the student and subsequently approved by the coordination.
Module II – Family and Descent and Distribution Civil Law (32h)
The aim of this module is to reflect on and discuss the institutions in family and descent and distribution applied law, from an asset evaluation perspective. This does not mean the imposition of an asset-based conception of family law, but a revision of Patrimonial Civil Law through an existentialist perspective imposed by the process of constitutionality that Brazilian law has undergone.
Evaluation: This module’s evaluation will happen through a written exam.
Module III – Patrimonial Civil Law (212h)
The aim of this module is to revisit the main institutions and issues in Property Law and Contractual Law, in light of the preconditions established in Module I. The primary theoretical objective is to comprehend Civil Law critically, by building a notion of property that is adequate to our Constitution, in order to fully achieve equity in private rights.
Evaluation: This module will be evaluated through the preparation of an article and the submission to specialized scientific journals.

There will not be classes every week – two weeks of class will be followed by one free week, making the course not excessively tiring for students but ensuring it will be concluded before December 2018.
